1.1 Seller identity

This website and online shop are operated by Kristaltærar Minningar ehf. (Arctic Crystal Memories), Icelandic ID number (kennitala) 620626-3250, VAT number 162007, Faxafen 10, 2nd floor, 108 Reykjavík, Iceland ("Arctic Crystal Memories", "ACM", "we", "us" or "our"). You can contact us at [email protected] or +354 761 7603. Faxafen 10 is our legal, postal and pre-arranged return address, and our retail shop opens there on 1 November 2026. Until that date the address is not a walk-in shop and visits are by prior arrangement only. The company is registered in the Register of Limited Companies (hlutafélagaskrá) maintained by Skatturinn, the Iceland Revenue and Customs. The business is not subject to a licensing requirement and has no sector-specific supervisory authority beyond the general oversight of Neytendastofa (the Consumer Agency) and Persónuvernd (the Data Protection Authority).

1.2 Scope and structure

These Terms & Conditions govern accounts, use of Configure Your Crystal, saved designs, purchases, payments, delivery, returns, the Photo Policy, privacy and cookies on acm.is, arcticcrystalmemories.is and the ACM Android app that securely displays the same service. All chapters form one document. A product page, the final checkout summary, an order confirmation and any written order-specific agreement also form part of the contract. If they conflict, an individually agreed order term takes priority, followed by the final order confirmation and then these Terms.

1.3 Acceptance and mandatory consumer rights

You are asked to confirm these Terms when registering and again when placing an order. Photo-processing terms are also shown when a Configure Your Crystal design is saved. The version accepted at the relevant time applies to that action. Nothing in these Terms removes a consumer right that cannot lawfully be waived under Icelandic law, including rights under Act No. 16/2016 on consumer contracts and Act No. 48/2003 on consumer purchases.

1.4 Eligibility and accurate information

You must have legal capacity to create an account or contract with us. A person under 18 may order only with the permission and involvement of a parent or guardian. You must provide accurate, current contact, billing, delivery and design information and update it if it changes.

1.5 Language, access and effective date

The Terms are available in Icelandic and English and can be saved or printed from this page. We aim for the versions to have the same meaning. For sales specifically directed to Icelandic consumers, the Icelandic text controls if a translation conflict cannot reasonably be resolved. These Terms are effective from 5 August 2026.

2.1 Products, Configure Your Crystal previews and customer approval

Our crystals are made from the product, size, orientation, photo, text, layout, accessories and other choices shown in your final order. Configure Your Crystal is a design aid. Screen colours, brightness, scale and the simulated engraving can differ from the physical crystal, and reasonable production adjustments may be required for a technically sound engraving. You must review the spelling, names, dates, crop, orientation and overall preview before ordering.

2.2 Ordering steps and correction

A saved design or cart is not a purchase. Before submitting an order, checkout shows the selected items, customisation, delivery method, address, price, VAT, delivery charge and total, and lets you correct them. Selecting the final purchase action sends you to Teya Hosted Checkout. You can still leave without paying. An order becomes binding only after Teya confirms successful payment and ACM issues an order confirmation. An automated receipt does not prevent us from correcting an obvious pricing, stock or technical error; if we cannot fulfil an accepted order, we will notify you and refund the affected amount.

2.3 Personalised production

Most products designed through Configure Your Crystal are made to your individual instructions. After payment, an order may briefly remain Confirmed while we perform internal checks. Contact us immediately during that stage if you spot an error; any cancellation or correction is subject to our confirmation and is not a statutory right. When the status changes to Processing/In production, substantive photo preparation, layout or engraving work has begun or been committed and the personalised specification is locked. The withdrawal exception and refund consequences are explained in Chapter 4 and are explicitly acknowledged at checkout.

2.4 Prices, VAT and currencies

The authoritative product prices are maintained in Icelandic króna (ISK). Prices shown to consumers include Icelandic VAT at the displayed rate unless clearly stated otherwise. Delivery charges and any optional additions are itemised before payment. Other display currencies are a convenience conversion and may change with exchange rates. The exact transaction currency and total shown in the final checkout and Teya payment page are the amounts you authorise. Your card issuer may apply its own exchange rate or fee.

2.5 Teya payments

Teya is ACM's online payment provider. Checkout redirects to Teya's secure Hosted Checkout, where Teya collects card and authentication details, supports applicable card-payment methods and performs payment-security and fraud checks, including 3-D Secure where required. ACM does not receive or store your full card number or card security code. We receive only the information needed to reconcile and support the purchase, such as payment status, amount, transaction or authorisation reference, payment method/card brand and masked card details. Teya's own privacy notice and payment terms apply to its service.

2.6 Authorisation, failed payments and refunds

A bank or Teya may decline, hold or reverse a payment. We are not responsible for a refusal caused by the payment provider, card issuer, incorrect details or an unavailable balance, but we will help identify the recorded order status. Do not repeatedly submit payment if the result is unclear; contact us to avoid duplicate authorisations. An approved refund is initiated through Teya to the original payment method. The time until it appears is then controlled by Teya and the receiving bank.

2.7 Promotions and obvious errors

Coupons and promotions apply only under their displayed dates, eligibility and product conditions and cannot be exchanged for cash. We may correct an obvious error before fulfilment. If the corrected price is higher after payment, we will ask whether you want to proceed or receive a full refund; we will not charge an undisclosed increase.

2.8 Electronic contracting, storage and correction

A contract is formed through the following steps: you add a product to the cart, enter checkout, provide delivery and payment details, review the final summary including the total price, and confirm the purchase using a button labelled with the obligation to pay. You are then directed to Teya Hosted Checkout. The contract is formed when Teya confirms payment and ACM issues an order confirmation.

Input errors can be corrected at every stage before the obligation-to-pay button is selected: in the cart, in the address and payment fields, and in the final summary, by going back and editing. After an order has been submitted, contact [email protected] without delay; see Chapter 4 for the Confirmed-to-Processing boundary.

ACM stores the order, the version of these Terms you accepted and the order confirmation. A signed-in customer can access them under Orders in their account; a guest can access them through the order confirmation email. These Terms can be saved or printed from the Terms page at any time.

A contract may be concluded in Icelandic or English.

2A.1 Online-only opening period

Arctic Crystal Memories is currently open online only. While this temporary pre-opening purchase mode is active, customers may place and pay for orders before the physical store opens and before the first stock shipment is available in Iceland. This allows a customer to reserve the selected products from the incoming stock.

2A.2 Expected delivery window

Our current good-faith estimate is that pre-opening orders will be delivered, shipped or made ready for collection between 1 and 10 November 2026. An order may be ready earlier, but an earlier date is not promised. We will provide order updates using the contact details supplied at checkout.

2A.3 Cancellation and refund before processing

Until the order status changes to Processing, the customer may cancel the pre-opening purchase and receive a full refund of all amounts paid for that order. This is an additional contractual cancellation right for the pre-opening period, including for a personalised product. The refund will be returned to the original payment method without undue delay. Once the order enters Processing, the ordinary personalised-product, cancellation, returns and refund provisions in these Terms apply.

2A.4 Delay or unavailable stock

If we reasonably expect that the order cannot be fulfilled within the stated delivery window, we will inform the customer without undue delay and provide a revised estimate. The customer may accept the revised date or cancel for a full refund. If an ordered product cannot be supplied, the customer may choose an agreed replacement or a full refund. Nothing in this supplement limits any mandatory right concerning late delivery, non-delivery, defects or refunds under applicable consumer law.

2A.5 Separate checkout acknowledgement

Before payment, the customer must separately confirm that the purchase is a pre-opening purchase, that the expected delivery or collection window is 1–10 November 2026 (possibly earlier), and that the special full-refund cancellation right lasts until the order enters Processing.

3.1 What the Photo Policy covers

This Photo Policy applies to every photo, design file, preview, text layer and related instruction uploaded to or produced through Configure Your Crystal or an order upload link. Photos may contain personal data about you or another identifiable person. We do not use facial recognition or process photos to identify people biometrically.

3.2 Legal basis for processing and what we do to your photo

ACM is the controller of any personal data your photo may contain, as set out in Chapter 7. Processing is carried out because it is necessary to perform our contract with you or to take steps at your request, under point 2 of Article 9 of Act No. 90/2018. By uploading and saving a photo you ask ACM to prepare a design from it and produce the selected crystal, and authorise the adjustments reasonably necessary to do so. This includes automated or manual background removal, cropping, resizing, rotation, colour/contrast/brightness correction, cleaning edges, retouching minor visual distractions, converting formats, separating subjects, arranging text and polishing the image for the clearest practical crystal engraving. We will follow the selected product and your choices in Configure Your Crystal, but may make proportionate technical adjustments needed for engraving quality.

This authorisation is needed to perform the design or purchase service; it is not permission to use your photo in advertising. We will not publish, sell, train a public model on, or use a customer photo or design for marketing, a portfolio or social media without a separate, specific permission.

3.3 Your rights and responsibilities

You confirm that you own the photo or have permission from the rights holder and every person whose permission is reasonably required, including a parent or guardian for a child.

Copyright in a photograph normally belongs to the photographer, not to the person shown in it and not to the person who paid for the session. This includes wedding, school, sports and portrait photographs taken by a professional. Before uploading such a photograph you must have obtained the photographer's permission to reproduce and adapt it, under Articles 2, 5 and 49 of the Copyright Act No. 73/1972. It is your responsibility to establish who holds copyright in the image. If a dispute with a rights holder arises we will pause production or delivery of the affected item until it is resolved, and refund the order where appropriate. ACM may decline a photograph that carries a watermark, a photographer's stamp or other indication of third-party rights until permission is provided. You must not upload unlawful, threatening, hateful, sexually exploitative, privacy-invasive or infringing content. ACM may refuse and securely delete content that appears unlawful, unsafe or unsuitable for production and may refund or cancel the affected item as appropriate.

3.4 Private Cloudflare storage and access

Customer photo and design files are stored in ACM's private Cloudflare R2 customer bucket and are not public product images. Access is limited to authorised ACM personnel and service systems that need the files for Configure Your Crystal, production, support, security or deletion. Short-lived signed links may be generated to display a private image to an authorised customer or administrator. Reasonable technical and organisational safeguards reduce risk, but no internet storage can be guaranteed completely risk-free.

3.5 Unsold Configure Your Crystal design retention: 7 or 30 days

A Configure Your Crystal design saved by a guest remains an unsold draft and is automatically eligible for deletion after 7 days without that specific design being reopened. A Configure Your Crystal design saved to a signed-in account is eligible after 30 days without that specific design being reopened. Opening that exact design in Configure Your Crystal updates its updatedAt timestamp and restarts the applicable 7- or 30-day clock. Opening another design does not reset it.

Saving a design, receiving a recovery link or adding the design and related products to the cart is not a sale and does not by itself stop draft deletion. The sale occurs only after checkout and successful Teya payment. Cleanup runs periodically, so deletion may occur shortly after the stated threshold rather than at an exact minute. A 90-day Cloudflare object-lifecycle rule is only a storage safety backstop; it does not extend the 7- or 30-day draft promise.

3.6 Paid-order photo retention: three months after sale

Once a design becomes part of a successfully paid order, the short draft clock stops. The photo, engraving preview and working design assets are retained for production, delivery support and resolution of quality issues for three months after the sale, and are then deleted from active customer-image storage. We may isolate and retain a necessary file for longer only while a specific complaint, chargeback, legal claim, fraud/security investigation or legal preservation duty is active. Order, invoice and limited payment records are separate records governed by Chapter 7 and do not require us to keep the photo.

3.7 Deletion requests and production limits

You may ask us to delete an unsold design or, after fulfilment, the related photo sooner. We will comply where the file is no longer needed to provide the requested service or protect a current legal claim. Deleting an account does not undo completed production and does not require deletion of statutory accounting records. Keep your own copy: saved designs are a temporary convenience, not a permanent photo archive.

3.8 Quality of submitted photographs and ACM's image enhancement process

The result inside the crystal depends substantially on the original photograph. We recommend an image of at least 600 × 600 pixels, in focus, evenly lit and with a clear subject. Screenshots, images compressed by repeated messaging between phones, very dark or very bright images, and images with significant motion blur are less suitable.

An image that falls short of these guidelines is not automatically rejected. ACM runs such images through a dedicated enhancement process — including upscaling to roughly 2K, sharpening, noise reduction, background removal where needed and correction of brightness and colour — and works from the improved version. The process improves the result but cannot create detail that is not present in the original.

ACM reviews every image before production begins. If we consider that an image will not produce an acceptable result even after enhancement, we contact you before production starts and offer you the choice of sending a different image, proceeding on your own assessment, or cancelling the item for a refund. If you choose to proceed after such a warning, ACM is not liable for quality attributable to the original image, under Article 16(4) of Act No. 48/2003. This does not affect ACM's liability for production defects, incorrect text, incorrect layout or transport damage.

4.1 Statutory 14-day withdrawal right for eligible goods

Under Act No. 16/2016, a consumer generally has 14 days to withdraw from an eligible distance purchase without giving a reason. At ACM, this applies to eligible standard, non-personalised stock products, for example a standard light stand or other accessory purchased without individual engraving or modification. It does not apply to a personalised crystal described in section 4.2. For goods, the period normally starts when the consumer or a nominated third party takes physical possession; special timing rules apply to split deliveries. You may exercise the right using the standard withdrawal form on our Right of withdrawal page, or by any other unambiguous statement sent to [email protected] before the deadline. If you submit a notice through an electronic form on our website, we will send you an acknowledgement of receipt on a durable medium without delay. You then normally have 14 days to send the eligible product back.

If an order contains both a personalised crystal and a separable eligible standard item, the 14-day change-of-mind right applies only to the eligible standard item. Returning that item does not create a right to return or receive a refund for the personalised crystal.

4.2 Important exception for personalised crystals

The statutory change-of-mind withdrawal right does not apply to goods made to the consumer's specifications or clearly personalised. Every crystal made or engraved using your selected photo, text, names, dates, layout, orientation or other individual choices in Configure Your Crystal is such a personalised product. At checkout you explicitly confirm the Terms and acknowledge this exception. There is no 14-day or 30-day change-of-mind refund right for the personalised crystal.

This exception does not remove your rights if a product is defective, damaged, not as agreed or incorrectly made.

4.3 Confirmed-to-Processing cancellation boundary

While a personalised order is still marked Confirmed, contact us immediately if you want to cancel or correct it. If we confirm that substantive work has not begun or been committed, we may voluntarily approve the request and, for an approved full cancellation, refund the cancelled amount through Teya. Approval is not guaranteed and is not a statutory withdrawal right.

Once the order changes from Confirmed to Processing/In production, photo preparation, layout, engraving or other personalised production work has begun or been committed. From that point, the customer has no change-of-mind right to cancel the personalised crystal or demand a full refund. This operational boundary does not affect remedies for a defect, incorrect production, non-conformity or transport damage.

4.4 Defects, damage and non-conformity

ACM remains responsible for delivering goods that conform to the contract and for transport risk until you, or a third party designated by you other than the carrier, receives them. Inspect the parcel promptly. If an item arrives damaged, incorrect or apparently defective, contact us without undue delay and include the order number and clear photos where reasonably possible. We may offer repair, replacement, price reduction, cancellation or refund as required by law and proportionate to the issue.

Under Article 27 of Act No. 48/2003 a complaint must be made without undue delay, and no period shorter than two months from the date the consumer discovered the defect may be imposed. The general complaint period is two years from receipt, and five years where the item is intended to have a materially longer service life than goods generally. A defect appearing within six months of delivery is presumed to have existed at delivery unless proven otherwise, under Article 18(2) of the same Act. Your remedies are those listed in Article 26: withholding payment, requiring repair or replacement, a price reduction, cancellation, or damages.

4.5 Returning an eligible item

Arrange a return before sending anything by contacting [email protected] or +354 761 7603. We will confirm instructions and, where needed, the return address. Our pre-arranged return address is Kristaltærar Minningar ehf. (Arctic Crystal Memories), Faxafen 10, 2nd floor, 108 Reykjavík, Iceland. Do not make an unannounced visit. You must handle return goods with reasonable care. For a valid change-of-mind withdrawal, you normally bear direct return cost and may be responsible for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. ACM bears reasonable return cost for a confirmed defect, damage in transit or our fulfilment error.

4.6 Refund timing and method

For a valid statutory withdrawal, we refund eligible payments, including the least expensive standard outbound delivery offered, no later than 14 days after receiving the withdrawal notice. We may withhold the refund until the goods are returned or you supply evidence of sending them, whichever occurs first. An extra amount paid for premium delivery is not refundable unless required by law. Approved refunds are sent through Teya to the original payment method; bank processing time is outside ACM's control.

5.1 Available fulfilment methods

The delivery or collection methods actually available for your destination are shown at checkout. They may include shipment by the named carrier or collection at the location and times stated in the order confirmation. A legal or return address is not automatically a public collection point. Delivery charges are shown before purchase.

5.2 Production and delivery estimates

Our products are personalised, laser-engraved optical K9 crystal. They require photo preparation, engraving, cleaning, quality checking and protective packing before dispatch. Production time and carrier transit time are separate parts of an estimate. Any production, dispatch or delivery date is an estimate unless we expressly agree a fixed date. The estimate begins after successful payment and after we have all usable photos, approvals and delivery information. If your input is missing or unsuitable, the estimate may pause while we contact you.

5.3 Protective packing and handling

K9 crystal is a substantial, rigid and breakable optical material. We inspect each finished crystal, use packaging reasonably designed to protect its polished faces, corners, engraving, presentation box and any light base or accessory during normal carrier handling, and request or mark fragile handling where the selected carrier offers it. Keep the product upright or supported as indicated, lift heavier pieces carefully, and retain all packaging until you have inspected and tested the complete order. Packaging reduces transport risk but cannot make fragile crystal unbreakable.

5.4 Address and delivery cooperation

You must provide a complete and accurate delivery address, recipient name, phone number and any customs information requested. Contact us promptly if something is wrong. We may charge the reasonable direct cost of resending an order returned because of an incorrect address, refusal or failure to collect, unless the failure was ours or cancellation rights require otherwise.

5.5 Risk and carrier responsibility

For a consumer purchase, ACM carries the risk of loss or damage until you or your nominated third party, other than a carrier independently chosen by you, takes physical possession. We may pursue the carrier ourselves and will not require you to surrender mandatory consumer rights merely because a carrier caused the damage. Ownership passes no later than full payment and delivery, subject to mandatory law.

5.6 Delay, loss or damage

If a material delay becomes known, we will provide available information and a revised estimate. Mandatory remedies for late delivery remain available. When the parcel arrives, check the outer package, presentation box, crystal surfaces and corners, internal engraving and included base/accessories. Report visible or concealed damage, a missing parcel, or a parcel marked delivered but not received as soon as reasonably possible. Keep the crystal and all inner and outer packaging and provide clear photos where available; this helps us document the carrier claim but is not used to remove a mandatory remedy where other reasonable evidence exists.

5.7 International delivery

Where international delivery is offered, the customer is responsible for giving accurate import information and for import duties, taxes or carrier clearance fees not included in checkout. Customs processing can delay delivery. Nothing in this clause transfers ACM's pre-delivery transport risk or removes mandatory consumer rights.

Since 1 July 2026 the European Union has removed the former EUR 150 customs exemption and applies a flat EUR 3 duty to each consignment valued at EUR 150 or less. It is collected from the recipient at customs clearance and is not part of any payment to ACM.

6.1 Account registration and sign-in

You may register with email credentials or Google. On the registration page, both methods require confirmation that you have read the Privacy chapter and accept these Terms. Google also processes sign-in data under its own terms and privacy notice. Existing customers do not need to reaccept merely to sign in unless the Terms materially change and renewed acceptance is required.

6.2 Account security

Keep credentials and recovery links confidential and notify us promptly of suspected unauthorised access. You are responsible for activity reasonably attributable to your account until you notify us, except where law or our own security failure places responsibility elsewhere. We may require verification before disclosing or changing account information.

6.3 What a saved Configure Your Crystal design is

A saved Configure Your Crystal design is a temporary editable draft. It is not a product reservation, purchase, order, payment, permanent storage service or promise that a product or price will remain available. Adding the draft and related products to a cart is still not a sale. A sale occurs only after the order is submitted and Teya confirms successful payment.

6.4 Draft inactivity clocks

Guest drafts are eligible for automatic deletion after 7 days of inactivity; signed-in account drafts after 30 days. Each clock is tied to that specific design's updatedAt field. Reopening that exact design through Configure Your Crystal refreshes updatedAt and restarts its clock. Viewing a list, signing in or opening another design does not refresh it. The detailed file rules are in the Photo Policy.

6.5 Conversion to an order

When successful payment attaches a design to a confirmed order, it is no longer treated as a pending saved draft. Order-related access and editing depend on the order status: a limited edit may be offered before production, while designs in production are locked to protect the approved specification. Photo assets then follow the three-month post-sale rule in Chapter 3; order and invoice records follow Chapter 7.

6.6 Post-payment design amendments

A signed-in customer may be offered a limited amendment editor while the order is still Confirmed and has not entered Processing/In production. Photo placement, existing engraving content and special instructions may be corrected during that window. A newly selected paid service or matching keychain is not applied for free: ACM calculates the additional amount from the paid order snapshot, creates a separate Teya payment linked to the same order, and applies the addition only after that payment is confirmed. A supplemental invoice may be issued for the addition.

The light-base selection is fixed when the original order is placed and cannot be added, removed or exchanged through the customer editor. Contact ACM by phone, WhatsApp or the Contact page about a light-base change. If ACM approves removal of an eligible separately priced stand, an administrator processes the refund to the original payment method before the order is updated. Removing another already-paid service or accessory in the editor does not itself create a refund or credit. Once the order enters Processing/In production, the design is locked. These voluntary amendment facilities do not create a cancellation, withdrawal or refund right beyond Chapter 4.

6.7 Acceptable use and account action

Do not misuse the site, attempt unauthorised access, interfere with security, scrape at harmful volume, upload malicious code or use another person's account. We may temporarily restrict or close an account where reasonably necessary for security, unlawful use, serious breach or protection of customers. Where appropriate, we will explain the action and allow correction. Closing an account does not cancel a paid order or erase records we must retain.

6.8 Account deletion

You may request account deletion through Account Settings, the public account-deletion page at acm.is/en/legal/account-deletion, or [email protected]. The public page remains available if you uninstall the Android app. We verify ownership, delete or anonymise account data that is no longer needed, and retain only limited order, accounting, consent, security, support or claim records for the periods and lawful purposes explained in Chapter 7.

7.1 Controller and contact

Kristaltærar Minningar ehf. (Arctic Crystal Memories), kt. 620626-3250, Faxafen 10, 2nd floor, 108 Reykjavík, Iceland, is the controller for personal data processed through the website, ACM Android app, shop, accounts, Configure Your Crystal, orders and direct support. The Android app securely displays the same acm.is service and requests internet access only. Privacy questions and rights requests may be sent to [email protected] or +354 761 7603.

7.2 Data we process

Depending on how you use the service, we process identity and contact data; account and Google sign-in identifiers; delivery, billing and company details; cart, product, Configure Your Crystal and order choices; customer photos, previews, text and design settings; support messages, returns and claim evidence; consent and marketing preferences; IP/device, security and technical logs; anonymous or pseudonymous analytics events; and limited Teya payment metadata. Teya, not ACM, receives full card and card-security data.

7.3 Purposes and legal bases

We use data to create accounts, preserve requested drafts, prepare images, take payment, make and deliver orders, provide support and handle returns because it is necessary to take requested steps or perform a contract. We keep invoices and transaction records to comply with accounting, tax and consumer law. We protect the service, prevent fraud, establish legal claims, improve operations and produce limited business statistics on the basis of our legitimate interests, balanced against your rights. Optional analytics cookies, marketing cookies and promotional communications rely on consent where required and can be withdrawn without affecting prior lawful processing.

7.4 Recipients and service providers

We disclose only what is necessary to providers supporting the requested service, including Teya for Hosted Checkout and refunds; Cloudflare for private image/object delivery and site infrastructure; our hosting and PostgreSQL database environment; Resend and relevant email infrastructure for transactional messages; Google when you choose Google sign-in; delivery carriers for shipping; and professional advisers, insurers, banks, authorities or dispute bodies where reasonably required. These providers process data under their own legal duties and/or contracts with us. We do not sell customer personal data.

7.5 International processing

We prefer European storage regions for customer files, but some providers or support functions may process data from another country. Where personal data leaves the EEA, we use an adequacy decision, approved contractual safeguards or another lawful transfer mechanism as applicable. Provider privacy notices give further detail about their own processing.

7.6 Retention

Unsold Configure Your Crystal design drafts and images follow the specific 7-day guest and 30-day account rules in Chapters 3 and 6. Photo and working design assets attached to a paid order are retained for three months after sale, subject to the narrow live-claim exception in the Photo Policy.

Order, invoice, tax and limited payment-reconciliation records—including payment status, amount, Teya references, method/card brand and masked details—are normally retained for seven years from the end of the relevant financial year where required for Icelandic accounting and tax records, and longer only for an active legal hold or claim. Full card details are not part of ACM's database.

Account/profile data is kept while the account is active and then deleted or anonymised when no longer needed, except for records linked to the above obligations. Security logs are kept only for a proportionate period needed to detect and investigate misuse. Consent records are retained for the active consent period and necessary proof. Aggregated statistics that no longer identify a person may be retained longer because they are no longer personal data.

7.7 Your rights

Subject to applicable conditions, you may request access, correction, deletion, restriction, portability or objection, and may withdraw consent at any time. We may need to verify your identity and may retain information where a contract, accounting duty, security need or legal claim requires it. You may complain to Persónuvernd, the Icelandic Data Protection Authority, at personuvernd.is. Exercising a right is normally free of charge.

7.8 Security, children and automated decisions

We use access controls, private storage, signed links, encryption in transit, password hashing and operational safeguards appropriate to the service. You should still keep copies of important photos and protect your account. The service is not directed to children acting alone; a parent or guardian must be involved. ACM does not make decisions producing legal or similarly significant effects solely through automated profiling.

7.9 Direct marketing

Transactional messages about an account, design, order, security or requested support are not marketing. Promotional email or advertising audiences are used only where there is a valid legal basis and any required consent. You can unsubscribe from promotional email or change cookie settings at any time.

8.1 Cookie choices

The site uses cookies and similar browser storage. Necessary technologies operate where required to deliver a feature you request, secure the site, keep a cart/session or remember a consent decision. Preferences, analytics and marketing are separate optional categories. They are off until you choose them. The banner offers "Only necessary" and "Accept all" with equal prominence, and Cookie settings allows category-by-category control.

8.2 Necessary cookies and storage

Examples include Auth.js session/security cookies; acm_guest_token for the guest cart; acm_design_guest_token for design recovery; acm_design_retention_ack for the saved-design notice; and acm_cookie_consent for recording your choice. Cookie expiry and design retention are different: a guest token may remain available after a 7-day draft has been deleted and cannot restore the deleted draft. Necessary cookies cannot be disabled in our settings because the requested account, cart, security or consent feature would not work correctly without them.

8.3 Preference cookies

If permitted or set through a choice you request, acm_theme, acm_locale and acm_display_currency remember theme, language and display currency, generally for up to one year. acm_remembered_email stores an email—not a password—for up to 30 days when "remember me" is chosen. Local storage may remember that a non-essential notice was dismissed. Clearing these values resets the preference.

8.4 First-party analytics

With Analytics/Statistics consent, ACM records limited first-party page-view and product-view events and an anonymous session identifier so we can understand traffic and improve the shop. The analytics route checks consent before recording. These events are not designed to store a name, email, photo or full IP address and are not sold. Declining analytics does not reduce shop functionality.

8.5 Advertising and marketing cookies

Marketing consent is reserved for advertising technologies such as Meta Pixel or Google Ads tags, audience/remarketing functions and advertising conversion measurement. These technologies can recognise a browser across sites, measure campaigns and help ACM or an advertising partner show more relevant advertising. No such marketing tag may load merely because the category exists: it must remain blocked unless and until you opt in and ACM actually enables the named service. We will update this chapter when a marketing provider is introduced. Declining marketing has no effect on your ability to buy.

8.6 Teya and external services

When you follow checkout to Teya's separate Hosted Checkout, Teya may use its own necessary security, payment, fraud-prevention and preference technologies under Teya's notices. Those technologies are controlled on Teya's domain, not by ACM's cookie setting. Google similarly applies its own technology if you choose Google sign-in.

8.7 Duration, proof and withdrawing consent

The ACM consent cookie records the selected categories, decision time and policy version for up to one year. Optional consent can be changed or withdrawn at any time through the persistent Cookie settings link in the footer; the new choice applies going forward. You may also clear or block cookies in the browser, although blocking necessary storage can break account, cart or design-recovery features. We ask again when the consent expires or a material category/provider change requires a new decision.

9.1 Website and intellectual property

The website, crystal previews, product photography, branding, software and ACM-created text and artwork are protected by applicable intellectual-property law. You may use the site for personal shopping and design purposes. You retain rights in material you upload and grant ACM only the limited processing rights in the Photo Policy. You may not copy, resell, reverse engineer or commercially exploit ACM content or systems without permission, except where law expressly permits it.

9.2 Service availability and liability

We use reasonable care to keep the service accurate and available, but maintenance, networks, devices and third-party services can cause interruption. We do not exclude liability for fraud, wilful misconduct, gross negligence, personal injury caused by negligence, breach of mandatory consumer law or anything else that cannot lawfully be limited. Subject to those rules, neither party is liable for remote or unforeseeable indirect loss. For a business customer, additional reasonable limitations may be agreed in writing; consumer statutory remedies remain unaffected.

9.3 Events outside reasonable control

A party is not in breach for delay caused by an event genuinely outside its reasonable control, such as a major infrastructure failure, natural event, strike, government restriction or carrier shutdown, provided it takes reasonable steps to reduce the effect and informs the other party. This does not remove a consumer's mandatory right to cancel for serious delay or receive a refund where required.

9.4 Complaints and resolution

Please first contact [email protected] or +354 761 7603 with your order number and the outcome you request. We aim to acknowledge a complaint promptly and resolve it fairly. If a consumer dispute cannot be resolved, you may refer the matter to the Complaints Board for Goods and Services (kærunefnd vöru- og þjónustukaupa), the statutory consumer dispute-resolution body under Act No. 81/2019.

General information about consumer rights is available from Neytendastofa (the Consumer Agency), neytendastofa.is. If ACM rejects your claim we will provide this information to you in writing or on another durable medium without delay, under Article 6(2) of Act No. 81/2019.

9.5 Governing law and courts

These Terms and contracts with ACM are governed by Icelandic law. Disputes not resolved by agreement or an available complaints body may be brought before the Icelandic courts, subject to applicable venue rules. If you are a consumer habitually resident in another EEA country, this choice does not deprive you of mandatory protection granted by the law of your residence or any court access that cannot lawfully be restricted.

9.6 Changes, severability and contact

We may update the Terms for legal, security, provider or service changes. The version accepted for an existing paid order continues to govern that order unless a change is required by law or agreed with you. Material changes affecting ongoing account use will be communicated or presented for renewed acceptance where appropriate. If one provision is unenforceable, the rest remains effective and the provision is interpreted as closely as lawfully possible to its intended purpose.
